Ending the Dairy Milk Mandate: FISCAL Act
Ending the Dairy Milk Mandate
FISCAL Provisions Enacted into Federal Law
In a major step forward for student choice and dietary equity, key provisions of the Freedom in the School Cafeterias and Lunches (FISCAL) Act were successfully incorporated into the bipartisan Whole Milk for Healthy Kids Act, signed into law by President Trump on January 14, 2026.
For decades, federal school meal policy effectively required cow’s milk while limiting access to plant-based alternatives, often only available with a doctor’s note. The updated law changes that. Schools are now able to offer nutritionally equivalent plant-based milk options more freely, helping ensure that all students, including those who are lactose intolerant, have allergies, or choose plant-based diets, have meaningful access to beverages that meet their needs.
This outcome reflects years of advocacy to modernize school nutrition policy, reduce unnecessary barriers, and promote inclusive, science-aligned food options. While more work remains to fully end the outdated milk mandate, the inclusion of FISCAL provisions marks a significant federal victory for common-sense reform.
